Terms and Conditions

Welcome to ZangCash Pay!

These Terms and Conditions (“Terms”) govern your access to and use of the eBook sales platform operated by ZangCash Pay (“we,” “us,” or “our”). By using our platform, purchasing our eBooks, or interacting with our services, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please refrain from using our platform.

1. Definitions

  • User/Customer: Any individual who purchases or accesses eBooks through our platform.
  • eBook: A digital version of a book, article, or other written work available for purchase on our platform.
  • Platform: The website or digital platform operated by ZangCash Pay where eBooks are sold.
  • Purchase: A transaction in which a user buys an eBook through our platform.
  • License: A limited, non-exclusive, non-transferable right to access and view the purchased eBook.
  • Digital Download: The process of downloading a purchased eBook to a user’s device.

2. Account Registration and Management

2.1 Eligibility

To make a purchase, you must:

  • Be at least 18 years old.
  • Provide a valid email address.
  • Mpesa Phone Number
  • Ensure your billing information is accurate and up-to-date.

2.2 Account Creation

To purchase an eBook, you must create an account. During the registration process, you will need to provide:

  • Full name.
  • Email address.
  • Mpesa Phone Number
  • Billing details.

2.3 Account Security

You are responsible for maintaining the security of your account details. Please keep your password confidential and notify us immediately if you suspect any unauthorized access to your account.

2.4 Account Termination

We reserve the right to suspend or terminate accounts for violations of these Terms, fraudulent activities, or misuse of the platform.

3. eBook Purchase and Licensing

3.1 Purchasing eBooks

You may purchase eBooks directly from our platform. Upon completion of the purchase, you will receive access to download your eBook(s).

3.2 License to Use eBooks

Upon purchase, we grant you a non-exclusive, non-transferable license to download and view the eBook on your personal devices. This license is for personal use only and does not grant you any rights to distribute, resell, or share the eBook.

3.3 Restrictions on Usage

You may not:

  • Copy, modify, or redistribute the eBook without permission.
  • Use the eBook for commercial purposes or resale.
  • Extract, reproduce, or reverse-engineer content in violation of copyright laws.

3.4 Buying, Selling eBooks & M-Pesa Wallet Use

A. Buying and Selling eBooks – Basic Guidelines

i. Buying eBooks

  • 3.4.1 Purpose of Purchase: Users may purchase eBooks for educational purposes and for the opportunity to earn income through resale.
  • 3.4.2 Instant Access: Upon successful payment, the eBook is available for instant download.
  • 3.4.3 Fixed Buying Prices: eBook prices are pre-determined based on category:

  • 3.4.4 Bulk Purchase Option: Users may purchase multiple eBooks at once. Bulk purchases may increase potential for faster resale.

ii. Selling eBooks

  • 3.4.5 Minimum Resale Wait Time: A user must wait 24 hours after purchasing an eBook before listing it for resale.
  • 3.4.6 Estimated Selling Duration: Resale of eBooks may take 1 to 7 days or longer, depending on platform demand and availability of buyers.
  • 3.4.7 Sales Not Guaranteed: While the platform makes reasonable efforts to facilitate eBook resales, successful resale is not guaranteed.
  • 3.4.8 System-Defined Selling Prices: Selling prices are set by the platform. Profit margins typically range between Ksh 30 to Ksh 50 per eBook to maintain consistency and fairness.
  • 3.4.9 Payout Upon Sale: Once a user’s eBook is sold, their profit is automatically and instantly credited to their wallet balance.

B. M-Pesa Wallet Transactions

i. Top-Up Guidelines

  • 3.4.10 How to Add Funds: To fund the platform wallet:
    • Navigate to the Wallet section and tap “Top Up”.
    • Use the platform’s provided Paybill number.
    • Follow payment instructions as provided.
  • 3.4.11 Instant Credit Update: Wallet balances are updated immediately upon successful M-Pesa transaction confirmation.

ii. Withdrawal Guidelines

  • 3.4.12 How to Withdraw Funds: To initiate a withdrawal:
    • Go to the Wallet section and tap “Withdraw”.
    • Input the amount to be withdrawn.
    • Confirm the request.
  • 3.4.13 Instant Transfers: Withdrawals are processed instantly to the registered M-Pesa number.

C. Disclaimers & General Notes

  • 3.4.15 Educational and Earning Platform: This platform is not a get-rich-quick scheme. Its main objective is to empower users through knowledge and fair digital commerce.
  • 3.4.16 Patience Requirement: Selling eBooks requires patience and consistency. Some eBooks may take longer than others to sell.
  • 3.4.17 Referral Program: Users are encouraged to refer others to increase platform visibility and boost personal earnings.
  • 3.4.18 Standard Process Reminder: All users must follow the transaction process: Buy → Wait → Sell → Withdraw.
  • 3.4.19 eBook Sale Rejection: Some eBooks may be rejected by the platform for resale due to quality, duplication, or policy violations. Rejected eBooks will not be eligible for resale, and no credit or cash refunds will be issued.
  • 3.4.20 No Refund Policy: All eBook purchases and credit top-ups are non-refundable, regardless of usage or resale status.

4. Payments and Fees

4.1 Pricing

All eBooks are sold at the prices listed on our platform at the time of purchase. Prices are subject to change without notice.

4.2 Accepted Payment Methods

We accept various payment methods, including credit/debit cards, mobile payments, and other online payment services.

4.3 Taxes

Prices are inclusive of applicable taxes, unless otherwise stated.

5. Refund and Cancellation Policy

5.1 Refund Policy

Due to the digital nature of our eBooks, we generally do not offer refunds once the purchase has been completed and the eBook downloaded. However, if there is a defect in the eBook file or technical issues that prevent you from accessing the content, we may offer a replacement eBook.

5.2 Cancellation Policy

Cancellations are not permitted once the eBook has been downloaded. If you face technical difficulties or issues with your download, please reach out to our support team for assistance.

6. Intellectual Property Rights

6.1 Ownership

All content, including eBooks and materials available on our platform, are protected by copyright laws. We retain ownership of all intellectual property rights, and you are granted a limited license to use the eBook for personal purposes.

6.2 User-Generated Content

If you upload any content to our platform, such as reviews or feedback, you grant us a non-exclusive, royalty-free license to use, display, and share this content on our platform.

You agree to provide accurate and complete information when creating an account or making a purchase.

7.2 Compliance with Laws
